Terms of Service

Your account, plans and credits, what you may and may not do, and the legal terms that apply.

Agreement

These Terms of Service ("Terms") are a legal agreement between you and MediGent Technologies LLP ("Medigent", "we", "us"), governing your use of the Medigent platform, websites and apps. By creating an account or using Medigent you agree to these Terms and to our Privacy Policy. If you use Medigent for a clinic, you accept these Terms on the clinic’s behalf.

Who can use Medigent

You must be at least 18 years old. Doctors and clinic staff must be qualified and licensed for the services they offer through Medigent, and are responsible for meeting the rules of their profession and regulator. Patients use the free app to manage their own health information.

What Medigent provides

Medigent is software that helps a clinic run its front office: an AI receptionist that answers calls and takes booking requests, a clinic dashboard and electronic health record, e-prescriptions, patient reminders and a patient app.

Medigent organises information and sends reminders. It is not a medical device and does not provide medical advice, diagnosis or treatment. All clinical decisions are made by the treating clinician.

Your account

Plans, credits and payments

Doctors and clinics pay a subscription; some features use prepaid credits (1 credit = ₹1) spent only on AI usage and phone-number rental — for example voice minutes, AI chat bookings, AI drafts and monthly number rental. The patient app is free.

Prices are shown in the app and may change with notice. Payments are processed by our partners (PayU, Stripe); we do not store your card or UPI details. Applicable taxes, including GST, are added where required. The current rates are on the pricing page.

Cancellation and refunds

You can cancel your subscription at any time from your account. Cancellation stops future billing and takes effect at the end of the current billing period. Fees already paid and credits already spent are non-refundable and are not exchangeable for cash, except where a refund is required by law. Unused credits stay available while your account is active, subject to any stated validity, and can be refunded on request under the Refund & Cancellation Policy.

Clinic and patient data

For patient records the clinic is the data fiduciary, responsible for obtaining patient consent and for the accuracy of clinical information; Medigent processes that data on the clinic’s instructions. You keep ownership of your data and can export medical records in the open FHIR R4 standard. How we handle personal data is described in our Privacy Policy.

Intellectual property

Medigent, its software, brand and content are owned by MediGent Technologies LLP and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the service while these Terms are in force. You keep all rights to the data and content you put into Medigent.

Third-party services

Medigent works with third parties — cloud hosting, telephony, payments, messaging and AI providers. Features that rely on them may also be subject to their terms. We are not responsible for third-party services outside our control.

Availability and changes

We work to keep Medigent available and reliable but do not guarantee uninterrupted service. We may add, change or remove features, and may update these Terms; material changes will be posted here with a new date, and continued use means you accept the change.

Suspension and termination

We may suspend or end your access if you breach these Terms, fail to pay, or put the platform or others at risk. You may stop using Medigent at any time. On termination you can export your data for a reasonable period, after which it may be deleted under our retention practices.

Disclaimers and limitation of liability

Medigent is provided on an "as is" and "as available" basis, without warranties of any kind to the extent permitted by law. To the maximum extent permitted by law, MediGent Technologies LLP is not liable for indirect or consequential losses, and our total liability for any claim is limited to the fees you paid us in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.

Indemnity

You agree to indemnify MediGent Technologies LLP against claims and losses arising from your misuse of the service, your breach of these Terms, or your breach of any law or third-party right.

Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, the courts at Barabanki, Uttar Pradesh have exclusive jurisdiction over any dispute, without prejudice to any statutory grievance or consumer forum available to you.
